These terms and conditions of sale govern sales made on the website pomponandpets.com by Ms Camille Mermet-lyaudoz, POMPON&PETS, 91 rue de la Bonneterie, 84000 Avignon.

Article 1 — Purpose

These terms and conditions of sale govern the sale, by Ms Camille Mermet-lyaudoz, POMPON&PETS, 91 rue de la Bonneterie, 84000 Avignon, of dog accessories marketed through the website www.pomponandpets.com.

Article 2 — Prices

The prices of our products are shown in euros including all taxes, unless otherwise stated, and exclusive of handling and shipping costs.

If you place an order for delivery to a country other than metropolitan France, you are the importer of the product(s) concerned.

Customs duties or other local taxes, import duties or state taxes may be payable. These duties and sums do not fall within the remit of Ms Camille Mermet-lyaudoz, Pompon&Pets.

They will be payable by you and are your sole responsibility, both in terms of declarations and of payments to the competent authorities and bodies of your country.

We advise you to enquire about these matters with your local authorities.

All orders, whatever their origin, are payable in euros. Ms Camille Mermet-lyaudoz, Pompon&Pets, reserves the right to change her prices at any time, but the product will be invoiced on the basis of the price in force at the time the order is confirmed, and subject to availability.

The products remain the property of Ms Camille Mermet-lyaudoz, Pompon&Pets, until the price has been paid in full.

Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.

Article 3 — Orders

You can place your order:

• online: the contractual information is presented in French and will be confirmed at the latest when your order is confirmed.

Ms Camille Mermet-lyaudoz, Pompon&Pets, reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and in particular in the event of a supply problem or of a difficulty concerning the order received.

Article 4 — Confirmation of your order

Any order placed on the website implies acceptance of these General Terms and Conditions.

Any confirmation of an order entails your full and complete acceptance of these general terms and conditions of sale, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction.

You declare that you are fully aware of them. Confirmation of the order will constitute signature and acceptance of the transactions carried out.

Article 5 — Payment

Confirming your order obliges you to pay the price shown.

Your purchases are paid for by bank card through a secure payment system.

Your card is only debited when the order is shipped. In the case of split deliveries, only the products shipped are debited.

Article 6 — Withdrawal

In accordance with the provisions of Article L.121-21 of the French Consumer Code, you have a withdrawal period of 14 days from receipt of your products in which to exercise your right of withdrawal, without having to give reasons or pay penalties.

Returns must be made in their original and complete condition (packaging, accessories, instructions...).

In this context, you are liable. Any damage suffered by the product on this occasion may cause the right of withdrawal to be forfeited.

Return costs are payable by you.

If the right of withdrawal is exercised, Ms Camille Mermet-lyaudoz, Pompon&Pets, will refund the sums paid within 14 days of notification of your request, using the same means of payment as that used for the order.

Article 7 — Availability

Our products are offered for as long as they are visible on the website and while stocks last.

For products not held in stock, our offers are valid subject to availability from our suppliers.

If a product is unavailable after your order has been placed, we will inform you by e-mail. Your order will be automatically cancelled and no bank debit will be made.

Furthermore, the website is not immediately intended to sell its products in large quantities.

Consequently, Ms Camille Mermet-lyaudoz, Pompon&Pets, reserves the right to refuse orders for several identical items.

Article 8 — Delivery

Products are delivered to the delivery address given during the ordering process, within the time frame shown on the order confirmation page.

In the event of a shipping delay, an e-mail will be sent to inform you of any possible consequence for the delivery time you were given.

In accordance with the legal provisions, in the event of late delivery, you may cancel the order under the terms and conditions set out in Article L.138-2 of the French Consumer Code.

If you receive the product in the meantime, we will refund it together with the delivery costs under the conditions of Article L.138-3 of the French Consumer Code.

In the case of delivery by a carrier, Ms Camille Mermet-lyaudoz, Pompon&Pets, cannot be held responsible for late delivery due exclusively to the customer's unavailability after several appointments have been offered.

Please note that customs charges may apply to shipments outside the European Union.

Article 9 — Warranty

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects provided for by Articles 1641 et seq. of the French Civil Code.

If a product sold does not conform, it may be returned, exchanged or refunded.

All claims and requests for exchange or refund must be made by e-mail, telephone or post within 14 days of delivery.

Products must be returned to us in the condition in which you received them, with all their components (packaging, accessories, instructions...).

Shipping costs will be refunded on the basis of the rate invoiced, and return costs will be refunded on presentation of supporting documents.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

Article 10 — Liability

The products offered comply with current French legislation. Ms Camille Mermet-lyaudoz, Pompon&Pets, cannot be held liable in the event of non-compliance with the legislation of the country to which the product is delivered.

It is your responsibility to check with the local authorities whether the products you intend to order may be imported or used.

Furthermore, Ms Camille Mermet-lyaudoz, Pompon&Pets, cannot be held responsible for damage resulting from misuse of the product purchased.

Finally, Camille Mermet-lyaudoz, Pompon&Pets, cannot be held liable for any inconvenience or damage inherent in the use of the internet, in particular a service interruption, an external intrusion or the presence of computer viruses.

Article 11 — Law applicable to disputes

The language of this contract is French. These terms and conditions of sale are governed by French law.

In the event of a dispute, the French courts shall have sole jurisdiction.

Article 12 — Intellectual property

All elements of the website are and remain the intellectual property of Ms Camille Mermet-lyaudoz, Pompon&Pets. No one is authorised to reproduce, exploit, redistribute or use in any capacity whatsoever, even partially, any elements of the website, whether software, visual or audio.

Any simple link or hyperlink is strictly prohibited without the express written consent of Ms Camille Mermet-lyaudoz, Pompon&Pets.

Article 13 — Personal data

Ms Camille Mermet-lyaudoz, Pompon&Pets, reserves the right to collect identifying information and personal data concerning you.

They are necessary for the management of your order, and for improving the services and the information we send you.

They may also be passed on to companies that contribute to these relations, such as those responsible for carrying out services and orders, for their management, execution, processing and payment.

This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the French law of 6 January 1978, you have a right of access to, rectification of and objection to the identifying information and personal data concerning you, directly on the website.

Article 14 — Archiving, proof

Ms Camille Mermet-lyaudoz, Pompon&Pets, will archive order forms and invoices on a reliable and durable medium constituting a faithful copy, in accordance with the provisions of Article 1348 of the French Civil Code.

The computerised records of Ms Camille Mermet-lyaudoz, Pompon&Pets, will be considered by all parties concerned as proof of the communications, orders, payments and transactions that have taken place between the parties.
